Acceptable Use Policy

This policy constitutes an integral component of the agreement between the client and Divine Concepts and is applicable to clients utilizing Divine Concepts’ services.

Unacceptable use
  1. No Illegal or Harmful Use – You may not use the Services to publish content or engage in activity that is harmful to others or illegal under applicable law , including without limitation in connection with any of the following illegal, harmful or fraudulent activities:
    1. Disclosing private sensitive personal information about others;
    2. Distributing malware or other malicious code;
    3. Engaging in the unlawful distribution of controlled substances and drug contraband;
    4. Engaging in the unlawful distribution of prescription medications, including, but not limited to, promotion, marketing, or sale of prescription medications without a valid prescription;
    5. Gambling;
    6. Hosting child pornography or content that is potentially harmful to minors (Any website found to be hosting child pornography or linking to child pornography will be suspended immediately without notice and reported to law enforcement;
    7. Hosting FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme, High-Yield Interest Programs (HYIP) or related sites;
    8. Hosting or linking to a website intended to deceive the public including, but not limited to sites listed at aa419.org & escrow-fraud.com ;
    9. Hosting or linking to an anonymous proxy server;
    10. Infringing upon the Intellectual Property Rights of Others. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software/warez, or any other copyrighted work.
    11. Money laundering;
    12. Phishing or engaging in identity theft; and
    13. Selling weapons or ammunition.

  2. No Unauthorized System Access or Network Abuse – You may not use the Services to gain access into any network or system without permission. Prohibited activities include:
    1. Accessing another network without permission, to probe or scan for vulnerabilities or breach security or authentication measures;
    2. Attacking other networks (i.e. Denial of Service (DoS) attacks);
    3. Intercepting or monitoring data without permission;
    4. Running a file sharing site;
    5. Running any software that interfaces with an IRC (Internet Relay Chat) network;
    6. Using any deep-link, page-scrape, robot, crawl, index, spider, offline reader, click spam, macro programs, internet agent, or other automatic device, program, algorithm or methodology which does the same things, to use, access, copy, index, acquire information, generate impressions or clicks, input information, store information, search, generate searches, or monitor any portion of our website or servers for any unauthorized purpose;

  3. Don’t Hamper System Performance – Consuming excessive amount of server resources is prohibited. This leads to server performance issues and may cause a disruption to our systems or other customers. Use of any scripts or processes that may adversely impact our systems is prohibited.

  4. No Adult Content – You may not use the Services to distribute pornography or other adult-related content or offer any escort services.

  5. No Storage of Backups – Backing up personal data to a hosting account is prohibited. Our Services are designed to host your website, not serve as a data repository . We reserve the right to remove backups from your hosting account.
  1. Unlimited Bandwidth: Divine Concepts provides unlimited bandwidth for web traffic, ensuring your website can handle any volume of visitors without restriction.

  2. Responsible Usage: We enforce responsible usage policies to maintain fair resource allocation and prevent abuse of our hosting infrastructure.

  3. Security Measures: Our hosting packages include proactive security measures, such as regular updates and patches, to safeguard your website from threats and vulnerabilities.

  4. Data Protection: While we strive to ensure the security of your data, clients are responsible for regularly backing up their data to prevent loss or corruption.

  5. Acceptable Use Policy (AUP): Divine Concepts strictly prohibits activities such as storing malicious content, monopolizing server resources, and circumventing intended use of the product to maintain a secure and equitable hosting environment.

  6. Prohibited Activities: Clients are prohibited from engaging in activities such as running TOR services, using poor passwords, or conducting crypto currency associated activities within our hosting environment.

  7. Enforcement: Failure to comply with our Acceptable Use Policy may result in suspension or termination of hosting services. We take strict measures to ensure adherence to our policies and maintain the integrity of our hosting network.
  1. How much disk space and bandwidth will my plan include?

    Disk space and bandwidth is “Unmetered” which means you are not charged according to the amount of disk space or bandwidth you use. However, that being said, we do require all customers to be fully compliant with our Terms of Service and its policies, which includes our Acceptable Use Policy (“TOS”), and to only utilize disk space and bandwidth in the normal operation of a personal or small business website.

    For example, such customers who are using 25% or more of system resources for longer than 90 seconds would be in violation of our TOS, which includes our Acceptable Use Policy and other policies. Please see our TOS or contact us with any questions.

  2. What happens if I exceed usage?

    If we have concerns about your account’s bandwidth or disk space utilization, you will receive an email asking you to reduce usage. Again, it is very rare for a customer who is managing a personal or small business website to exceed our TOS, which includes our Acceptable Use Policy and other policies.

Definition of Spam: Divine Concepts regards unsolicited bulk email as spam, except in cases where:

  • There is a prior relationship between the sender and recipient, and the message concerns that relationship.
  • The recipient has explicitly consented to receiving the mail.

2. Client Responsibility: Clients should only receive bulk mail that they have requested, consented to, or would reasonably expect to receive due to an existing relationship.

3. Unacceptable Practices: Divine Concepts takes swift action against users engaged in the following practices:

  • Sending unsolicited bulk mail for marketing or other purposes to recipients who have not consented.
  • Using any part of Divine Concepts’ infrastructure for unsolicited bulk mail.
  • Operating mailing lists without the express permission of all recipients or maintaining “cleaning lists” obtained illegally.
  • Failing to promptly remove invalid or undeliverable addresses or unwilling recipients from lists.
  • Collecting responses from unsolicited email sent from accounts on other Internet hosts that violate this AUP.
  • Advertising facilities on Divine Concepts’ infrastructure in unsolicited bulk mail.
  • Including Divine Concepts’ name or IP addresses in unsolicited email headers.
  • Failing to secure a Client’s mail server against public relay, which may result in spam delivery. Divine Concepts reserves the right to examine users’ mail servers to confirm compliance.
  1. Clients are accountable for any misuse of Divine Concepts’ services that occurs through their account. It is the client’s duty to ensure that unauthorized individuals do not gain access to or misuse Divine Concepts’ service.

  2. Divine Concepts advises clients against responding to unsolicited mail or “spam” and refraining from clicking on any suggested links provided in such mail. Any actions taken by the client in response to unsolicited mail remain the sole responsibility of the client, and Divine Concepts cannot be held liable for the client being added to any bulk mailing lists as a result.

  3. In cases where the client has authorized a minor to use any of Divine Concepts’ services or access its websites, the client acknowledges that as the parent or legal guardian of that minor, they are fully responsible for: the online conduct of the minor, controlling the minor’s access to and use of any services or websites, and the consequences of any misuse by the minor.

1. Upon receipt of a complaint or upon becoming aware of an incident, Divine Concepts may, at its discretion, take any of the following actions:

2. In the case of clients, Divine Concepts may issue a warning, suspend the client’s account, and/or revoke or cancel the client’s service access privileges entirely.

3. If abuse is identified as emanating from a third party, Divine Concepts may notify the third party’s network administrator of the incident and request them to address the incident in accordance with this AUP and/or the ISPA Code of Conduct (if applicable).

4. In severe cases, Divine Concepts may suspend access to the entire network of the third party until abuse can be prevented by appropriate means.

5. In all cases, Divine Concepts reserves the right to charge offending parties for administrative costs and for any machine or human time lost due to the incident.

6. Divine Concepts may assist other networks or website administrators in investigating credible suspicions of any activity listed in this AUP.

7. Divine Concepts may institute civil or criminal proceedings as deemed necessary.

8. Divine Concepts may share information regarding the incident with other Internet access providers, or publish the information, and/or make available the users’ details to law enforcement agencies.

9. Divine Concepts reserves the right to suspend or terminate the service as provided for in the agreement.

This policy applies to and will be enforced for both intended and unintended prohibited usage, including but not limited to viruses, worms, malicious code, or otherwise unknown causes.

  1. Divine Concepts reserves the right to modify or revise this policy at any time, without prior notice to the client.

  2. Divine Concepts reserves the right to take appropriate action against individuals, companies, or organizations that violate the AUP or engage in any illegal activities while using Divine Concepts’ services, in accordance with applicable laws.

  3. Divine Concepts also reserves the right, at its discretion, to address other forms of abuse not explicitly outlined in this document and to investigate or prevent illegal activities occurring over Divine Concepts’ network.

  4. Divine Concepts does not forfeit its right to enforce this AUP at any point, nor does it waive its right to take further action, should Divine Concepts choose not to enforce a breach of the AUP at any given time.
