Terms of Service

This policy constitutes an integral component of the agreement between the client and Divine Concepts and is applicable to clients utilizing Divine Concepts’ services.

  1. Divine Concepts facilitates the registration of domains on the Internet through relevant governing bodies and provides hosting services for websites and related content on Divine Concepts servers on behalf of clients. These terms and conditions govern the use and registration of domain names and the web hosting services offered by Divine Concepts.

  2. Domain registration by Divine Concepts is carried out through approved Domain Registrars, such as OpenSRS (for gTLDs). While Divine Concepts may occasionally utilize other approved entities for registration, the availability of domains offered may be subject to limitations based on the registrar concerned.

  3. Divine Concepts’ hosting services and complimentary domain registration are bundled together and cannot be separated. Divine Concepts will not cover registration fees if not combined with any of their hosting products.

  4. Clients are obligated to adhere to the terms and conditions of the relevant domain name space (e.g., .com or .co.bw) under which any domain name registered on their behalf falls. Divine Concepts may provide links to these terms and conditions on the Divine Concepts website for the convenience of clients.

  5. In instances where Divine Concepts acts as a registrar or reseller to register a domain name for the client, additional terms may apply. Divine Concepts will furnish clients with a link to these terms, which are incorporated into this agreement by reference.

  6. Divine Concepts endeavors to ensure swift registration and subsequent DNS propagation. However, Divine Concepts cannot be held liable for any delays in the domain registration process. Initial setup fees are non-refundable, and domain name registration fees constitute a one-time payment subject to specific renewal charges.
  1. Domain registration may be provided free of charge with Hosting products, subject to the type and nature of the TLD (Top Level Domain). This offer is contingent upon the domain (and website content) being hosted with Divine Concepts for a reasonable duration. Divine Concepts reserves the right, at its discretion, to levy a parking fee if a minimum period (3 months) has not been observed on the Hosting product before downgrading to a Parking product. The fee will be determined based on the type of domain and applicable administration fees. Waiving such fees will be entirely at Divine Concepts’ sole discretion.

  2. Divine Concepts reserves the right to charge a domain registration fee (in arrears) for any domain name that is registered as a FREE domain with a hosting package and subsequently cancelled (or the domain is transferred) within 6 months of sign up. Such fee(s) will be invoiced exclusively at Divine Concepts’ discretion, and any leniency extended to Clients on previous occasions will not prejudice Divine Concepts’ right to enforce this clause. Such fees must be settled before any domain transfer can be processed with the applicable registrar.

  3. Divine Concepts has a zero-tolerance policy towards abuse of their free registration policy. Any such abuse will lead to immediate termination of the accounts concerned and the service agreement, along with potential further action to recover applicable costs from the client.

  4. Divine Concepts only offers Free Domain registration for “.co.bw” domains with new hosting package signups, or as Domain Parking offered as a “Free Gift” in Store Portal. Other TLDs or gTLDs are not included in the Free Domain Registration offer. Divine Concepts will register domains according to the clauses outlined above, but will not be responsible for any subsequent costs related to the domain, such as Annual Renewal Fees or Redemption fees. Clients bear sole responsibility for such fees, and Divine Concepts will not mediate disputes resulting from non-payment. Should such domains be automatically renewed, clients will be billed for such renewal without exception. Clients wishing to discontinue a specific domain must ensure that cancellation is processed before any such renewal is executed by Divine Concepts with the registrar concerned.
  1. Divine Concepts will register a domain for a specified period, typically one year.

  2. Subsequently, the client bears full responsibility for ensuring the renewal of the domain at the end of each period, including subsequent periods, until the domain is either cancelled or transferred by the client. This obligation extends to domains set to auto-renew. If the auto-renewal process fails, it is the client’s responsibility to notify Divine Concepts of the failure.

  3. Divine Concepts will make efforts to send a courtesy reminder to the client, which may include an SMS, email, or notification through Store Portal or the Divine Concepts App. However, these reminders do not transfer the responsibility to Divine Concepts for ensuring domain renewal.

  4. Failure of the reminder to reach the client, or failure to issue the reminder, does not constitute a breach of this agreement, as the reminder is provided solely as a courtesy.

  5. Clients registering domains are advised to keep track of the registration date and ensure timely renewal.

  6. Clients have the option to manually renew domains by accepting renewal in Store Portal or by selecting auto-renewal in Store Portal and ensuring that Divine Concepts processes it accordingly.
  1. Divine Concepts facilitates the transfer of existing (registered) domains from current hosting providers to Divine Concepts’ DNS and web servers.

  2. Upon requesting the transfer and accepting the relevant service terms, the client explicitly acknowledges that they have the authority to do so, either as the registrant of the domain in question or as an agent nominated by the registrant.

  3. By agreeing to the transfer, the client indemnifies Divine Concepts from any disputes regarding ownership of the domain and any claims arising as a result thereof.
  1. Cancellation will be handled according to the standard terms.

  2. Upon cancellation, whether initiated by the client or Divine Concepts, all data will be permanently deleted from Divine Concepts’ servers. Clients bear sole responsibility for ensuring backups of web content, email data, or any other stored data on their hosting space. Divine Concepts holds no liability for data loss and is not obligated to provide such data once the hosting contract term expires.

  3. Any backups created by Divine Concepts are for legal purposes only and not for data retention. They may not necessarily be provided to clients upon request.

1. Divine Concepts does NOT include SMTP mail services by default with shared hosting packages.

2. Divine Concepts reserves the right to propose suitable alternatives to the client and/or impose charges for excessive traffic or utilization of system resources, as it deems necessary at its discretion. Determination of excessive traffic or system resource usage will be conducted in accordance with the guidelines outlined in the Acceptable Use Policy.

3. Divine Concepts reserves the right to transfer a website between web servers and Internet backbones, both domestically and internationally, as deemed necessary. If a client exceeds their monthly web traffic allocation, Divine Concepts will communicate with the client and present various options.

4. Divine Concepts reserves the right (without assuming any obligation) to examine the content of data transmitted, received, or stored on a Divine Concepts server to ensure compliance with this agreement, Divine Concepts’ AUP, or any relevant laws, regulations, or codes of practice.

5. The client is required to promptly and adequately address a denial of service attack (DOS/DDOS). If a client’s facilities are targeted by a DOS attack affecting other network users, the client’s service will be suspended.

6. Divine Concepts reserves the right to request additional information concerning the hosting of domains or physical and cloud servers managed by Divine Concepts.

7. Divine Concepts reserves the right to immediately suspend or terminate services without liability if additional information is not provided upon request.

8. The use of Hosting services with Divine Concepts is strictly subject to 3rd party and upstream licensing requirements or agreements. Failure to provide correct or complete information may result in service suspension or termination without prior notice.

Divine Concepts ensures that its hosting services will achieve 100% availability, with the following conditions:

  1. The 100% website uptime guarantee applies only in the event of a crash or unscheduled downtime of the web server hosting a client’s web hosting service. This guarantee does not apply if there is a network issue between the client and the web server preventing access to the website. For example, if the client’s ISP’s connection to the data center is interrupted, Divine Concepts is not liable if the web server is still operational.
  2. Divine Concepts is not responsible for outages caused by third-party network or service failures (such as network infrastructure, client’s internet connection, or externally managed firewall services). If the web server remains operational, the website is considered to have achieved 100% uptime.

  3. The 100% uptime guarantee does not cover scheduled maintenance of Divine Concepts’ web servers. Clients will receive notification of scheduled maintenance at least 24 hours in advance. Maintenance will be conducted after hours (based on Central African Time) to minimize web server downtime.

  4. The 100% uptime guarantee is not applicable if Divine Concepts suspends the client’s service as permitted under this agreement.

  5. Third-party monitoring service reports cannot be used as justification for uptime claims due to various factors, including network capacity and transit availability. Server uptime is defined by the reported uptime from the operating system and Apache Web Server, which may differ from other individual services.

  6. Disputes regarding the Uptime Guarantee must be submitted in writing. Claims for downtime may not exceed the fees paid to Divine Concepts for services not received during the downtime period. No direct or indirect losses or damages resulting from downtime may be claimed. Service level commitments will also be considered during dispute resolution. Disputes will be dismissed if agreed provisions are met.

  7. The services provided offer internet access, which is subject to bandwidth limitations, system failures, and other factors that may affect client access. Divine Concepts accepts no responsibility for such issues.

Each individual email sent to the client’s POP3/IMAP inbox or forwarded to the client’s current email address may have a size limit of 3000kB.

  1. Divine Concepts shall not be held liable for any loss or damage, business interruption, or any indirect, special, incidental, or consequential damages of any nature (including lost profits), regardless of the legal basis of the claim, whether contractual, tortious, or otherwise, arising from or attributable, directly or indirectly, to the use and/or registration of the client’s selected domain names, OR ANY ACTION TAKEN BY Divine Concepts IN RESPONSE TO THE ABUSE OF THE DOMAIN REGISTRATION SERVICES WHICH IT PROVIDES.

  2. The client hereby indemnifies and holds harmless Divine Concepts against any loss arising from any dispute, claim, or other action resulting from the client’s use and registration of its selected domain name, even if Divine Concepts has been informed of the potential for such damages.

  3. Divine Concepts shall not be liable for any indirect or consequential loss, damage, cost, or expense of any kind, regardless of the cause, whether arising under contract, tort, or otherwise, including, but not limited to, data loss or corruption, loss of profits, contracts, operational time, and goodwill.

  4. Neither Divine Concepts, its employees, affiliates, agents, third-party information providers, merchants, licensors, nor the like, guarantee that Divine Concepts’ server service will be uninterrupted or error-free; nor do they warrant the results that may be obtained from the use of the Server service or the accuracy, reliability, or content of any information service or merchandise provided through the Divine Concepts server service, unless otherwise explicitly stated in this agreement.

  5. Divine Concepts expressly limits its liability to the client for damages resulting from any non-accessibility time or other downtime to a pro-rata monthly charge during the system unavailability. Divine Concepts specifically disclaims any responsibility for damages arising as a result of such unavailability.

  6. Divine Concepts is not responsible if an external company’s network and firewall are configured to block access to services provided by Divine Concepts. If a client’s network is configured to block certain ports or web addresses compromising the services provided by Divine Concepts, it is the client’s responsibility to adjust their network configurations as necessary.

  7. Clients also indemnify Divine Concepts against any third-party claims against themselves as resellers or for services provided to the public or privately. Clients will be solely liable to external parties for losses and may not seek compensation from Divine Concepts for such losses or liabilities, either directly or indirectly. Divine Concepts is also indemnified from direct claims from clients for losses incurred due to third-party actions or claims.
